Terms of Service and General Terms of Sale

1 ❖ Acceptance of Terms of Use

Access to the BeFreelancr Site is reserved for members (see definitions below). A visitor can become a member of the Site for free by clicking on "Registration" and filling out the registration form. By creating an account, the member accepts all of these general terms and conditions. The member can delete their account at any time (see below).

2 ❖ Definitions

"Site", "Platform", "Marketplace": This website befreelancr.com.

"Member": Any person who uses the site, whether as a client, freelancer, or affiliate (or several of these cases).

"Freelancer", "Seller": Member who sells their services on the platform.

"Affiliate": Member who recommends their own services or the services of other freelancers through the affiliate program.

"Client", "Buyer": Member who purchases one or more services on the platform.

"URL": Internet link starting on this platform with https://befreelancr.com/. This link will provide access to a specific page on the site.

"Username": Name chosen by a member during registration, which will be visible on their profile page.

"Personal Link": A member's personal link is the URL (page link) accompanied by their username.

"Cookie": Small file placed on the visitor's browser that retains information for future connections.

"Service": Online service offered by a seller to clients.

"Option": Additional paid services offered within a service. A service may have between 0 and 10 options.

"Conversation": When a client places an order, a conversation will be created between the client and the seller to allow exchange between the two members. Once the order is completed, the conversation will be closed.

"Referral Program": Members who wish can sponsor new sellers, and in return receive commissions on these sellers' sales.

"Affiliate Program": Each member can, if they wish, promote the platform and the platform's services. And in return for this promotion, the member will receive commissions on their recommendations.

"Excluding Tax": Amount excluding Value Added Tax (VAT) of an order.

"VAT": Value Added Tax, depending on the buyer's country.

"Including Tax": Amount of an order including VAT.

3 ❖ Account

A BeFreelancr account is necessary to be able to buy, sell, recommend services, or recommend the platform.

3.1 ❖ Account Creation

By clicking on "Sign Up" and filling out the account creation form, you can become a member. Account creation is immediate after validating the form. Being a BeFreelancr member is free. Only services are paid. As well as the "Verified Seller" option which is completely optional (see the section on this topic).

When a client places an order, they must create an account in order to have access to their personal space where they will find their purchase invoices, but also their conversations with the seller(s).

3.2 ❖ Publication of Public Information

By joining BeFreelancr, members agree that some of their information will be public. Here is the information that will be public and visible to all: members' first names, the first letter of their last name (or their full name if they decide), their country, and their profile picture if they wish to display one.

In the interest of transparency and reassurance for their clients, sellers will be required to have a profile picture or their agency logo. No other information will be visible on the platform.

3.3 ❖ Account Modification

Members can modify their information in their personal space, and these modifications are immediate after the member's validation.

3.4 ❖ Account Deletion

Members can request the deletion of their account via live chat or at support@befreelancr.com. Deletion will be performed by the platform within 72 hours. On the other hand, in case of non-compliance with these terms of use, the platform may suspend or even delete an account.

4 ❖ Services

Members can add their services on the platform and receive orders.

4.1 ❖ Creating a Service

Publishing a service is free and unlimited. This means that a seller can create as many services as they wish. However, the platform reserves the right to accept or refuse services (see below).

4.1.1 ❖ Options

Each service can include up to 10 options. Options are optional. A seller may advise a client to take an option, but cannot force them to do so.

4.1.2 ❖ Selling Price

Services can be sold between €10 excluding tax and €10,000 excluding tax. And options between €5 excluding tax and €5,000 excluding tax. The platform reserves the right to refuse a service if the selling price is not consistent with the service offered.

4.1.3 ❖ Delivery Time

When a member adds a service, they must choose the delivery time. This delivery time is between 1 day and 30 days. And additional days can be added for each option. The seller commits to using all possible means to deliver to the client within the deadline.

4.1.4 ❖ Express Delivery

The seller can offer a paid "Express Delivery" and thus commits to delivering to their client more quickly.

4.1.5 ❖ Copyright

For graphic design services (logo creation for example), the author, i.e., the seller, will by default be the copyright owner of their work. They may transfer the copyright for free or sell the copyright transfer via an option in their service.

In all cases, whether the transfer is free or paid, the seller must send their client a copyright transfer document.

4.2 ❖ Acceptance or Refusal of a Service

When a service is created by a seller, the platform must accept or refuse it. The platform reserves the right to request modifications from the seller (for example to correct spelling mistakes).

In the interest of quality and image, the platform reserves the right to refuse any service that does not meet its conditions, without having to provide justification.

4.3 ❖ Modification of a Service

A seller can modify their services at any time, whether it is already published, awaiting verification, or in draft. In all cases, a service will be re-verified after a modification.

4.4 ❖ Deletion of a Service

A seller can unpublish one of their services at any time. It will therefore be invisible on the platform, but ongoing orders for this service will still be in progress. To permanently delete a service, the seller must contact the platform via live chat or at support@befreelancr.com.

For its part, the platform can unpublish a service if the average rating is below 3/5 and there is a minimum of 3 orders. The platform will contact the seller to find solutions to improve the service and the satisfaction of future clients.

5 ❖ Order

An order involves several steps.

5.1 ❖ Placing an Order

First, the client places their order by choosing their options and quantity. Right after the order, the client is redirected to the conversation between them and the seller. An automatic message will appear, with the seller's questions in order to fulfill the order under the best conditions.

The client should respond to the questions (also called "Brief") as quickly as possible, so that the seller can get to work.

5.2 ❖ Acceptance or Refusal of the Order

Once the order is placed, the seller will accept or decline the order. In case of refusal to handle the order, the seller must justify their refusal. And the client will be fully refunded.

5.3 ❖ Cancellation of an Order

The client can also cancel an ongoing order by contacting the platform via live chat or at support@befreelancr.com. In this case, the client must specify the reason for their cancellation.

5.4 ❖ Delivery of an Order

When the seller has completed their work, they deliver the order. Once the order is delivered, the client has 48 hours to request revisions. After this period, the order will be completed.

5.5 ❖ Rating of an Order by the Client

Once the order is delivered, the client can rate and comment on the order. The client's rating and comment will be visible to members and visitors of the platform. This rating will be taken into account in the average rating of the service. If a service has too many negative ratings, the platform may suspend this service.

5.6 ❖ Rating of an Order by the Seller

The seller must in turn rate the client and respond to the comment left by the client. The response to the comment will be public and visible to members and visitors of the platform. However, the rating will be visible only to the seller who assigned it, to the client themselves, and to the platform. If a client has too many negative ratings, the platform may suspend their account.

5.7 ❖ Invoicing for Clients

When a client places an order on the platform, an invoice is generated and is immediately available for an unlimited period in their client area. It is the platform that invoices the client, including the seller's commissions, but also those of affiliates through whom the client discovered the platform.

6 ❖ Sale of Services

BeFreelancr is a marketplace that allows all its members to sell their online services without any fixed fees. The platform takes a commission on each order, but if a member seller makes no sales, they have no fees.

6.1 ❖ Commission Rates

When a sale is completed and the client has been delivered, the member who performed the service can receive 60% excluding tax of the order amount excluding tax. The commission rate is the same, regardless of the order amount.

6.2 ❖ Obtaining a Verified Account

The seller can, if they wish, have their account verified to obtain a "Verified Seller" badge. To obtain it, the seller must pay the sum of €25 excluding tax, and send via live chat, a photocopy of their ID or their business registration. The platform will verify the seller's identity, and add the "Verified Seller" badge within 48 hours.

7 ❖ Referral

BeFreelancr aims to have as many talented sellers as possible. And to promote this, the platform has set up a referral program. If a member knows someone who would like to sell their services on BeFreelancr, the member sends their personal link to this person, and if they register through their link, they are added to their network.

7.1 ❖ Commission Rates

When a member sponsors/recruits/refers a new seller, this person becomes their referral. The recruited seller will receive 60% commission on their own sales, like all sellers on the platform. And the sponsor (the member who recruited the seller) will receive 5% on all the seller's sales.

8 ❖ Affiliation

To find clients, BeFreelancr has developed an affiliate program, also called a recommendation program. Members who wish can recommend the platform or services by sending their personal link (affiliate link) to other people. In exchange for their recommendations, the platform pays them commissions.

8.1 ❖ Commission Rates

When a person goes through a member's affiliate link and makes a purchase, the member receives 20% commission excluding tax on the order amount excluding tax. The member can also sponsor affiliates and receive 5% on all their recommendations.

9 ❖ Remuneration

Site members can earn commissions in different ways. By selling their own services, by referring other sellers, by promoting their own services and the services of other sellers, and finally by sponsoring other affiliates.

9.1 ❖ Invoicing to the Platform

In their personal space, members can see the available amount they can withdraw. At any time, they can send their invoice to the platform, as well as their bank details (if it's their first payment or if they have changed bank accounts since their last payment).

9.2 ❖ Payment Threshold

Site members can request payment of their commissions when their balance is greater than or equal to €30.

9.3 ❖ Payment Deadline

Payment is made within 7 days after receiving the member's invoice.

9.4 ❖ Payment Method

There are two payment methods on BeFreelancr: Bank Transfer and PayPal. If the member is located in the SEPA zone, payment will be made by bank transfer. And if they are located outside the SEPA zone, payment will be made via PayPal. In case the member does not have PayPal, another solution will be found so that they can receive their commissions.
